Gift Aid. 8 September 2016, 12:03. Things to avoid when claiming Gift Aid. Every year, around 70,000 charities claim tax reliefs worth billions every year. But as anyone who has ever interacted with the Gift Aid system knows, it isn’t always plain sailing.

Charities can reclaim gift aid on many of the donations received from private individuals. Charities are able to give the public the assurance that they are being monitored and advised by Office of the Scottish Charity Regulator (OSCR), or in England and Wales, The Charity Commission.

A charity or CASC may be able to do so using the HMRC Charities Online webpages. A charity or CASC must be recognised by HMRC as a charity or CASC for tax purposes before HMRC will accept a Gift Aid claim. HMRC may ask to see the declarations, so charities and CASCs must keep these records to support their Gift Aid repayment claims.

Gifts from UK donors to charities in another EU member state, Norway, Iceland or Liechtenstein are eligible for Gift Aid, provided that the charity satisfies the conditions in the Finance Act 2010 and is registered with HMRC (see Question 6). Whether (and to what extent) these rules will continue to apply when the UK leaves the EU remains to be decided.
